Terms and conditions

Dear customer,

The following terms and conditions regulate the contract relationship between the customer and Silvias Buggyservice.

In this agreement "you" are the customer and "we" are Silvias Buggyservice.

General terms and conditions:
We agree to hire out the equipment to you subject to availability and as specified in a confirmatory email or letter that we shall send to you upon receipt of your booking.

You shall make payment by bank-remittance (or credit card / debit card over the PayPal payment system (www.paypal.com)), although we reserve the right to allow payment by other means at our discretion.

Before your order can be accepted, we must receive from your bank or paypal an authorisation of payment for the whole of the price for the equipment hire that you order.

Once if we have received the payment, our acceptance of your order brings into existence a legally binding contract between us. We reserve the right to terminate our contract with you if we are refused authorisation for payment at any stage.

We reserve the right to cancel the contract between us at any time before delivery.

You acknowledge and agree to be bound by the terms of our privacy policy.

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

These terms and conditions, together with our current website prices, delivery details, contract details and privacy policy, set out the whole of our agreement relating to the supply of the equipment to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of ant good offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Terms and conditions:
The customer explains and agrees into this, that

  • (1) if the equipment we deliver is not what the customer ordered or is damaged or defective or the delivery is delayed we shall have no liability to the customer unless the customer notify us in writing at the email address or fax number (contact details see below) immediately upon the delivery of the equipment in question. If the equipment is assumed without complaint within 1 hour, this is regarded as accepted;
  • (2) all equipment supplied to the customer shall at all times remain the property of Silvias Buggyservice and it is to be returned on the agreed date in the same condition in which the customer received it;
  • (3) at a delayed return of the hired equipment the costs of the owner resulting for it (for example for a second hotel tour) will pay the customer; Late fees will be charged (for example at 25,00 EUR per standard pushchair per day);
  • (4) the customer is the only person whom is permitted to use the hire equipment and that he doesn't award the equipment to another person;
  • (5) he inform the owner immediately in the case of a loss or damage of the equipment;
  • (6) he use the equipment in a safe and sensible manner and in accordance with both the purpose for which it was supplied and the instructions. He will take the full responsibility for all damages to the hire equipment and the full cost recovery for these damages;
  • (7) he can make no demands against the owner with not proper operation (also nonobservance of the safety- and use-instructions which are enclosed in the hire pushchair or hire pram) and the consequences;
  • (8) Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problems you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the equipment in question;
  • (9) Silvias Buggyservice will not be liable to the customer for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising from the use of our equipment. The use of our equipment is carried out at the customers own risk;
  • (10) he take care of and ensure the safekeeping of the equipment. At loss or theft of the hired equipment the customer pay the full costs. The customer will be liable for the replacement cost of the equipment in this event. For example at loss of a hire pushchair (type S1) 350.00 euros, at loss of a hire pushchair (type S2, S3) 450.00 euros, at loss of a hire pram (type S4) 500.00 euros, at loss of a hire pushchair or pram (type SX2, SX4) 950.00 euros and at loss of a hire travelcot, high chair, handcart and so on 250.00 euros for each item as well as respectively all costs which are further and resulting from it;
  • (11) he will give the hire equipment back on the agreed date in a proper condition and will pay cleaning charges in the amount of 25.00 euros to the owner at excessively strong pollution;
  • (12) he carefully read the safety- and use-instructions that we shall supply with the equipment prior to its use and to follow the instructions at all times whilst using the equipment and in the case of the nonobservance e.g. at excessively strong wear and tear by overload etc. or in case that the hire equipment comes into touch with saltwater, he will pay the repair costs as well as all further costs to the owner resulting from it;
  • (13) in the case of prolongations of the hire period, the customer has to inform the owner at least 24 hours before expiry of the original hire period;
  • (14) at cancellations up to 10 days before the start of the hire period, he will pay a cancellation fee in the amount of 15.00 euros to the owner and the rental fee cannot be refunded at later cancellations;
  • (15) the use of the hire pram (type S4) is permitted only with babies (at the time of the handing over of the hire pram) until an age of at most 6 months;
  • (16) the use of the pushchair (type S1 and S2) is permitted only with children (at the time of the handing over of the hire pushchair) until an weight of at most 16 kg;
  • (17) the use of the twin pushchair (type S3) is permitted only with children (at the time of the handing over of the hire pushchair) until an weight of at most 12 kg each;
  • (18) he can make no demands against the owner if objects were left in the hire equipment;
  • (19) the person obtained data which are made available by the customer being processed and used electronically of the owner as far as it is required for the contract execution;
  • (20) the place of jurisdiction and place of performance is the seat of the owner;
  • (21) we reserve the right to refuse any booking;
  • (22) our prices are subject to change without notice, but stand at the time submission of your booking;
  • (23) we try to be as accurate as possible in providing details and descriptions of the rental equipment for hire. The rental equipment hired by you will match the written description of the rental equipment on our website, however they may not necessarily match the photographs shown on our website;
  • (24) we shall make delivery at a mutually convenient time on or before the date the hire period starts. The customer is responsible for ensuring that an appropriate person is available at the delivery address to receive the goods. If no one is at the address when the delivery is attempted we shall retain the equipment. We shall leave notification of delivery and will telephone the customer to attempt to rearrange the delivery but in such instances we reserve the right to deliver late and to charge the customer for our additional delivery costs.


* Legal notice: Silvias Buggyservice Germany arranges the bookings in the different destinations in the order and on bill of the respective partner-companies. These companies are independent and autonomous so that a lease with all legal consequences comes about exclusively between the customer and the respective partner-companies. For the correct and punctual delivery of the articles, in a technically and hygienically perfect condition, the respective partner-company of Silvias Buggyservice Germany at the corresponding destination is liable. The address of the respective partners makes Silvias Buggyservices Germany available for the customer in the need.
